Question:I know there has been confusion as to whether or not this is copyrighted does anybody know whether it is or not. I would like to use it for an embroidery design which may be sold.

It certainly been copyrighted in 1927, by lawyer Max Ehrmann (1872-1945) based in Terre Haute, Indiana.
the first time it was copyrighted was in 1927. I suppose over the years they have updated the copyright because it is very popular.
