My younger handicapped brother isnt being picked up by the bus, Is there any guidelines for the handicapped?

Question:Hes in special educaiton and has several medical problems. He is also mentally handicapped and physically handicapped. Since he began school 5 years ago they have always came to my moms house and picked him up without incident. This school year, they are asking him to walk to the end of the block and cross busy street to catch bus. There are no bss monitors out here or anything. Does this sound right? Is there any rights for handicapped children in california?

The transportation director may also be a good person to call, in addition to the principal and special education director/superintendent. Don't be surprised if your mom needs to leave a message..keep calling back and leaving messages.
While it is the busiest time of the year, I would imagine it takes two days to completely straighten out.

Have your mom document everything in a notebook, including what she and the bus driver discuss, who she leaves messages with, etc.

If no calls are returned, etc, ask you mom to go to the school with her complaint in writing. Talk to the principal or assistant principal or special education department chair and give them the copies. Once they have it in writing there is no denial anymore. (Again document and let them see you document.)

If nothing else, call a news station. They love this kind of stuff.
The rules have changed. The ride is free. He just has to be at the bus pick up spot when it comes...

This is wrong and inhumane.Go and talk to the principal and if she doesn't do anything take it to the School District Board and then give them hell until they do because your brother is Physically Handicapped,he shouldn't be made to go across a busy street and catch the bus. The bus should come to him. This is wrong and should not be taken lightly! Make sure you give them hell until they pick him up because if you don't there only going to make things worse for you and your brother since the government is lazy and they know you wont do anything about it and just suck up to them. That is just wrong..They shouldn't do that. I wish you the best of luck for you and your brother.

Your mom needs to talk to the speical education supervisor at the board of education. If he is on an IEP (may be called somthing different I am from Oklahoma) the bus should pick him up at his front door, no matter what grade he is in. This is the second one I have answered that has been about a child in CA. Good luck.
I would suggest he doesn't look up the bus driver before he gets on and says "hello my name is forrest..forrest gump"

Absolutely wrong. If it's still in his IEP, I would call the director's office and tell them they are out of compliance with federal law and that you are giving them two days to get the bus in front of your house to pick him up. A lot of times the bus company will not take the IEP seriously, they are a separate entity and don't give a rat's behind about disabled children.
Anyway, Talk to the school, the director of special services for your district, and then if they don't fall into line, I'd call an advocate, like this one

I am so disgusted with some of these answers. Some people need to put other people down in order to feel good about them selves.
Any way...your brother has rights. Dont worry. Do what everyeone else has told you to do. Call principal. then call the special education director. tell them the situation. alot of times with special education they find random people to drive the buses for these kids. these people are alot like the nasty people who commented to your question. they are lazy and are trying to be slick with you and your family. go right to the school and demand to get your brother picked up where he should be. no excuses. if things dont change you can file a grievance against the bus company along with the help from the school. This is not right!

The IEP is a legal document and the school system must be compliant, regardless of what bus company they have contracted to pick up students. If the IEP states he must be picked up at the stop closest to home or curb to curb pickup, then they are out of compliance. With a mental disability, it wouldn't be safe for him to judge when it is clear to cross the road. It would be a liability for the school system to have him picked up there. If the IEP does not state door to door pickup, then it must be amended to reflect that. Your parents can also ask for a bus assistant if your brother needs it. Your parents are a part of the IEP team, and make decisions regarding transportation, goals, etc. Your parents should not allow him to be picked up at the current stop. They should contact his case manager to set up a new IEP meeting where this issue can be discussed. Get his teacher on board. If the IEP team does not address this satisfactorily, then contact the ESE administrators at the school board administration building. Read the Procedural Safeguards which are given prior to the IEP meetings. The Procedural Safeguards are the rights of the student & parents. It lays out the steps the parent needs to take if an agreement can't be met. Best wishes to your family.
