To qualify for an IEP a child must have a documented disability that fits into one of the eligibility categories defined in the federal legislation IDEA. Additionally the child's disability must impact their ability to make progress in the general education curriculum to the point that special education services are needed for the child to make progress (that is basic accommodations/ modifications via an SST or other procedure should be exhausted.)

If there is a discrepancy between what you are able to do and what you are doing then you get an iep - meaning the ability is there to learn but something (like processing information) is not working.
