Section 82 and 83???

Question:section 82 of IPCsays that nothing is an offence which is done by a child under 7 years...
sec 83 says that nothing is an offence which is done by a child above 7 years and under12 years if he is not mentally mature...
now my question is if some offence is done by a child who is 7 years 3 months old...he will defend himself under which section...
i feel this will come under 83 section but my teacher says this is under section 82.
even in my text book it is specified that this is under sec 82.
i dont know how???/

Even if the child is only 7 yrs and on his 7th birthday he commits an offence it will invite section 83. Of course his lawyer can argue that though he is chronologically 7 years old, mentally he is not as mature as a normal 7 year old should be.
Bring it to the teaches attention that 82 says under 7 years so it has to be 83, 7 yrs and under 12 yrs.
Section 83. He could be 7 years, 1 second, and he falls under that rule. The second he turns seven, he's under section 83.
